Website Terms of Use

These Website Terms of Use (“Terms”) govern your access to and use of the websites and landing pages operated by The Neighbourhood Collective (ABN 57 425 323 500), trading as Cult Marketing (“we”, “us” or “our”), including cult.marketing and any artist, tour, release or campaign landing pages we operate (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 16 years of age to use the Site. By using the Site, you represent and warrant that you are 16 years of age or older. If you are under 16, please do not use the Site or submit any personal information to us.

2. About the Site

The Site is a marketing and information platform we operate on behalf of artists, promoters, labels and other clients. It may provide:

  • information about artists, tours, music releases and merchandise;
  • links to third-party websites, including ticketing partners, music streaming services, merchandise stores and artist websites; and
  • opt-in sign-up forms for mailing lists, tour announcements and related communications, which are administered through third-party platforms such as Audience Republic.

The Site is provided for your personal, non-commercial use only.

3. Acceptable use

When using the Site, you agree that you will not:

  • use the Site for any unlawful purpose or in breach of any applicable law or regulation;
  • scrape, harvest, mine or otherwise extract data from the Site by automated or manual means;
  • use bots, crawlers, spiders or any automated system to access the Site (other than standard search engine indexing);
  • reverse engineer, decompile, disassemble or attempt to derive the source code of any part of the Site;
  • impersonate any person or entity, or submit false or misleading information;
  • harass, abuse, threaten or harm any other user or any person referenced on the Site;
  • introduce any viruses, malware, or other harmful code to the Site;
  • interfere with or disrupt the Site, its servers, or any networks connected to the Site;
  • attempt to gain unauthorised access to any part of the Site, other accounts, or any connected systems; or
  • use the Site in any way that could damage, disable, overburden, or impair it.

4. Intellectual property

All content on the Site — including text, graphics, logos, images, video, audio, design, layout, code, and the selection and arrangement of content — is owned by us, our clients, or our licensors, and is protected by Australian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for personal, non-commercial use only. You may not copy, reproduce, modify, distribute, transmit, display, publish, sell, licence, create derivative works from, or otherwise exploit any content from the Site without our prior written consent.

All trade marks, service marks, logos and trade names displayed on the Site are the property of their respective owners. Nothing on the Site grants you any right or licence to use any trade mark without the prior written permission of its owner.

5. Data, insights and audience information

We retain ownership of the Site, all content we create or curate, the database underlying the Site, and all audience data, analytics, insights and campaign performance information that we generate through the operation of the Site (collectively, our “Data”).

We may share elements of our Data with the relevant artists, promoters, labels or other clients at our discretion or in accordance with our agreements with them. Where this involves your personal information, we will handle it in accordance with our Privacy Policy.

Your rights in respect of your own personal information — including the right to access, correct, opt out, and request deletion — are set out in our Privacy Policy and are not affected by this section.

6. Sign-ups and third-party services

Where you submit your details via a sign-up form on the Site, your information is collected and processed in accordance with our Privacy Policy and the terms and privacy policies of the third-party platforms we use (including Audience Republic).

You acknowledge that opting in via the Site may result in your details being shared with the relevant artist, promoter, label or campaign, as described in our Privacy Policy.

7. Third-party links

The Site contains links to websites and services operated by third parties, including ticketing partners, streaming services, merchandise stores, artist websites, and social media platforms. These links are provided for your convenience only.

We do not control, endorse, or assume responsibility for any third-party websites, content, products, services, or practices. Your use of any third-party website or service is at your own risk and is governed by that third party’s own terms and privacy policy. We encourage you to review them before engaging with any third-party service.

Any purchases, ticket transactions, or other dealings you enter into with third parties are solely between you and that third party. We are not a party to those transactions and have no liability in relation to them.

8. Disclaimers

To the maximum extent permitted by law, the Site and all content on it are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that any information on the Site is accurate, complete, current, or reliable. Information about tours, events, releases and merchandise is subject to change without notice.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be lawfully excluded or limited.

9. Limitation of liability

To the maximum extent permitted by law, we (and our directors, employees, contractors, related entities and clients) are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Site — whether based on contract, tort (including negligence), statute or otherwise — even if we have been advised of the possibility of such damages.

To the extent that liability cannot be excluded but can be limited, our total aggregate liability to you arising out of or in connection with the Site or these Terms is limited, at our option, to the resupply of the relevant services or the payment of the cost of having those services resupplied.

10. Indemnity

You agree to indemnify and hold us harmless from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

11. Changes to the Site and these Terms

We may modify, suspend or discontinue the Site (or any part of it) at any time without notice. We may also update these Terms from time to time by posting the updated version on the Site. Your continued use of the Site after any update constitutes your acceptance of the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them for the resolution of any dispute arising out of or in connection with these Terms or the Site.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use and disclose your personal information. By using the Site, you also agree to the terms of our Privacy Policy.
